The quoted prices shall only provide an idea of the cost levels involved in registering a design. The prices are based on an estimate of what it will cost for a design application containing 1 graphical representation, when you are represented by a professional. Therefore, the estimated total cost must in no way be equated with a precise calculation. Therefore, you ought to consult a professional representative in order to get a more accurate idea of what it will actually cost you to register your design.

DK application with professional consultant

If you want to get a design  registration  in your country of residence, you can  file  a national design  application. Then, from the date you  filed the national  application, you have six months to  file  design  applications in the other countries, if you want to use the  priority  of the national  application. Priority  means that your extended  application  will achieve  protection  from the date it was filed as a national  application.

Filing the  application

Reply from the relevant authority
When the relevant authority has received the  application, checks will initially be made to see whether the  application  complies with the requirements for obtaining a filing date. The  application  will then be examined and assessed for any deficiencies, whether the classification of products is correct and whether there are other hindrances to registering the design.

Any amendment of the  application
If there are deficiencies requiring your correction following the review and examination of the  application  before  registration, or if the  application  is deemed unsuitable for  registration, the relevant authority will write to you.

You must then respond to the letter you receive from your examiner, and amend the  application  accordingly. The examiner will then determine whether the  application  can now be approved.

The relevant authority will then make a decision in consideration of all the comments, presentations, etc.

The costs for processing a request for cancellation can therefore vary greatly depending on the complexity of the case.

A national design  registration  is valid for five years and can then be renewed every fifth year for up to 25 years.

You renew your design by paying the fixed  renewal  fee to the relevant authority.

If you want to get your trademark registered in many countries through the Geneva Convention, you have the option of obtaining protection of your design in several countries, both inside and outside Europe. You only need to file a design application directly with WIPO, who handle the international design. With this application you can apply for protection in the 59 countries that have acceded to the Geneva Convention.

WIPO registers your design if the formalities are in order, and then publishes the registration. At the same time, WIPO informs the countries, which you have selected in the application. However, the registration is not final before the national authorities of the designated countries have reviewed it.

If the national court in a designated country does not allow secrecy for such a long period of time, the registration will be published at the time that follows the national law in this country.

The total cost is calculated as the sum of the prices and fees, as specified on the timeline. However, the cost for processing any requests for cancellation is not included in the total costs, but is specified under total costs.

Some of the costs specified on the timeline will vary with the selected number of countries. The calculation does not take discounts and saved costs into account, e.g. re-utilizing already prepared material, and the result will therefore be subject to a degree of uncertainty. The more countries you select, the greater the uncertainty. It is therefore important that you consult a professional representative in order to get a more accurate idea of what it will actually cost you to register your design.
