What are the benefits of getting your trademark registered?
The registration of a trademark gives you a number of concrete benefits, e.g. the possibility of proving that it is your mark, and that you have exclusive rights to it.

By registering your trademark, you will not need to prove use to the same extent, and the scope of protection will also be broader than with trademarks acquired through use.

Having exclusive right to a trademark also means that you can prevent others from using an identical or similar trademark in connection with the same or similar goods or services, such as those, which your trademark is protected for.

General benefits of a trademark registration
There are many advantages to registering your trademark, e.g. you can:

  • Prohibit your competitors from using similar marks
  • Receive compensation in the event of infringement of your mark
  • You can sell or license the trademark to others and in that way generate income from the right.
  • Get an indication of which other similar trademarks have already been registered in your industry

Benefits of a national trademark, a community trademark and an international trademark
There are also a number of advantages to getting your trademark protected as a national trademark, a community trademark and/or an international trademark.

Benefits of a national trademark:

  • You are free to choose in which countries the registration is to be effective in
  • You can choose countries that are not members of the EU or the Madrid Protocol system
  • You can choose different trademarks in each country
  • If the trademark is cancelled in one country, it will not have any influence on the other national registrations, e.g. like a community trademark.

Benefits of a community trademark:

  • You get your trademark protected in all of the EU through one application
  • You can extend the rights from your old national registrations to the EU registration (seniority)
  • If you are selling the trademark, or if your company changes address, you only need to give notification thereof to one authority.
  • You only need to renew one registration

Benefits of an international trademark:

  • By filing one application you can obtain protection in the countries that are members of the international system, e.g. USA, China or Brazil.
  • You are free to choose in which WIPO countries the registration must apply
  • You have the option to extend the registration to several countries as your business grows
  • You can choose that the registration is to be valid in all of the EU, since OHIM is included in the Madrid Protocol system
  • If you are selling the trademark wholly or partially, or if your company changes address, you only need to give notification thereof to one authority.
  • You only need to renew one registration
